What is POSH Act?
POSH Act stands for Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.
The POSH Act, 2013 is India's statutory legislation mandating workplace safety and internal complaints mechanisms to prevent and redress sexual harassment.
POSH Act explained
Under the POSH Act, 2013, every employer employing 10 or more workers must constitute an Internal Complaints Committee (ICC) at every office, branch, or unit. The ICC must be chaired by a senior woman employee, have at least 50% women members, and include an external member from an NGO or legal background familiar with sexual harassment issues.
Employers must formulate an anti-harassment policy, display statutory notices, conduct periodic employee sensitization training, organize committee orientation sessions, and submit an Annual Report of inquiries to the District Officer before January 31st of each calendar year.
Non-compliance with ICC constitution or POSH obligations carries a statutory monetary fine of up to ₹50,000 for a first offense, escalating to doubled penalties and potential cancellation or non-renewal of business licenses upon repeated violations.
